By using MorningStack you agree to these terms. If you don't agree, please don't use the service.
What you buy
A one-time $45 payment unlocks a download of the MorningStack kit — a zip file containing Python scripts, HTML templates, demo brand data, and documentation. After delivery, the kit lives on your machine. You can use it forever, on as many of your own computers as you like.
"Forever" means: there is nothing on our servers your kit depends on after you've downloaded it. If we vanish tomorrow, your local copy keeps working.
Immediate delivery and waiver of withdrawal rights
By clicking "Pay" at Stripe Checkout, you expressly consent to immediate delivery of the digital kit and acknowledge that — under Article 16(m) of EU Directive 2011/83/EU — your right to withdraw from this contract is waived once delivery has begun. The kit email is sent within seconds of payment confirmation. Once sent, the purchase is final.
This is the legal basis for our no-refunds policy. It applies to all buyers, including EU and EEA consumers.
What you may not do
- Resell or repackage the kit as your own product (renaming, stripping our authorship, charging a licence fee for the same files). Bundling MorningStack into a service you provide is fine — that's what the Agency tier ($149) covers, with unlimited per-client deployments. See the agency FAQ on the landing page; the line is repackaging-as-your-own.
- Strip the original attribution / authorship from the kit files
- Use the kit or our infrastructure to attack, overload, or probe us
- Use the kit for anything illegal in your jurisdiction
You CAN share the kit with co-founders or teammates working on the same brands. You can modify it freely. You can include it in your own internal tooling. If in doubt: it's a tool you bought, use it like one.
Your data
The kit reads and writes local files on your machine — your brand config, follower counts, daily snapshots. None of that ever touches our servers. We only store what's needed to deliver the kit: your email, Stripe session ID, payment timestamp, and a download token. See the privacy policy for the full list.
Updates
Free updates for the life of the product. If we ship a v2 (or v3, v4), every existing buyer gets it free, sent to the same email used at checkout. We may roll major changes into a new product instead, in which case existing buyers either get it free or a meaningful discount — we'll decide case by case and announce it.
Accuracy of the kit
The kit reads your inputs and renders an HTML dashboard. RSS feeds are fetched from third-party sources we don't control — if a feed changes or breaks, the kit falls back to whatever you typed in brands.json. Follower counts are whatever you paste in — we don't pull from platform APIs. The kit is a presentation layer over data you maintain; it isn't an analytics platform, and it doesn't validate the numbers you put in.
Availability of the delivery API
To download the kit (initially and via the recovery page), our delivery API must be reachable. We aim to keep it up, but don't guarantee uptime. If the download endpoint is unreachable when you try, wait a bit and try again — Fly.io's machines auto-stop and may take 5–10 seconds to wake up. If it stays broken for more than an hour, email us.
Liability
To the maximum extent permitted by law, our total liability to you is limited to what you paid us — $45. We provide the kit "as is" and disclaim all warranties of fitness for purpose, merchantability, and non-infringement.
If we shut down
If we permanently shut MorningStack down: (a) we'll email every buyer at least 30 days in advance, (b) we'll publish the build/render code (the parts that make the dashboard) under a permissive open-source licence so anyone can continue iterating, and (c) we'll stop accepting new payments immediately. Your local kit keeps working regardless.
Changes to these terms
We may update these terms. Material changes (scope, price, jurisdiction) are emailed to every existing buyer at least 14 days before they take effect. Continued use after a change means you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of the Netherlands. Any disputes will be resolved in the competent courts of the Netherlands. If you are a consumer residing in the European Union, nothing in these terms deprives you of the protections of mandatory local consumer law — except, as noted above, the right of withdrawal under Article 16(m) which you waived at checkout.
